Dispute Resolution and Arbitration Agreement

Initial Dispute Resolution Procedure

If a controversy, claim, or dispute (a "Dispute") arises, you and the Dealership agree to first attempt an informal, good-faith resolution by providing written notice to the other party, allowing 30 calendar days to resolve the Dispute.

  • This procedure is a condition precedent before initiating litigation or filing a claim.

Arbitration, Class Action Waiver

IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE INITIAL DISPUTE RESOLUTION PROCEDURE, WE BOTH AGREE THAT THE DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS.

This means we agree to resolve any unresolved disputes through arbitration, which is an alternative to a court trial.
